Oh it'll definitely bruise an ego because they're not expecting it and they don't like it. And it'll definitely tick them off, too, to the point that ALL OF A SUDDEN! something was in plain view and/or you made a furtive movement. And not only can you refuse a vehicle search, you can also remain silent once Miranda is given.
And don't forget Amendment #5, too.It'll suck getting arrested, but that's what motions to quash arrest and suppress evidence are for, and that's what was done in this case, and you may win like this guy won.

He had no probable cause to search the car or call a dog for a cracked windshield. He was given a warning by the trooper. That should have been the end of the story. Trooper asked to search the car; Scott said no. Trooper should have sent him on his way at that point. He was unreasonably detained, not free to leave.

Only hitch to that, GS, is under one of the various proposals with the impending conceal carry law here is firearms are/may be banned on mass transit. So unfortunately it would have had no benefit.

ReplyThey also need to put some *much needed* street lighting there when walking west from the train station by Willie Brothers. It's virtually completely dark there, and getting off a late train and walking to your car is getting riskier, and this obviously confirms that.

Don't be surprised. 99.999% of people at an arraignment plead not guilty. It's routine. Judges sometimes enter pleas of not guilty for defendants if they're unable to do so. Or unwilling.

It's a law that they get credit for time served. He's in pretrial custody; he wasn't free. He was held because he was charged with a crime, and like everyone charged with a crime, a bond was set and in this particular case, he couldn't post bond.
And yes, other charges were dropped and yes, it was "Let's Make a Deal" because he pleaded guilty.
Take a sedative. Relax.
