Carlton Fisk Catches New Court Date
The Cooperstown catcher's drunken driving case was postponed again.
It's been a month and a week since baseball immortal Carlton Fisk was allegedly found passed out behind the wheel of his pickup in a New Lenox cornfield, but the former Red and White Sox star has yet to make it into a Joliet courtroom.
Fisk was scheduled for a hearing Thursday morning but his drunken driving case postponed until Dec. 17.
Fisk's lawyer, Stephen White, is fighting to get his superstar client's driver's license back and to have evidence ejected from the case.
Fisk, 64, lost his license when he allegedly refused to take a breathalyzer test during his arrest Oct. 22 on charges of driving under the influence, improper lane usage and illegal transportation of alcohol.
White has also filed a motion claiming the New Lenox police illegally arrested Fisk since there was "no reasonable suspicion of criminal activity" to give them cause to pull him over in the first place.
Fisk is fourth on the White Sox's all-time home run list and was inducted into the Baseball Hall of Fame in 2000. He owns homes in both New Lenox and Florida.

They didn't pull him over anywhere.....they found his car in the middle of a corn field with the motor running; open Vodka in the car; blown front tire; car in the ignition; and, Fisk sleeping in the car.
Why do lawyers think that all people are stupid and somehow, magically, Fisk's case will disappear?

But as a member of the Lincoln-Way School Board, Judge White would have no problem seeing a student expelled if a dog sniffed out pot in a student's car after the student allowed one of his buddy's to use the car and the buddy dropped some pot in it. Why the double standard?

His lawyer is just doing his job. Also, anybody who has ever been through the court system, or knew of somebody who has gone through it, knows that cases are continued over & over & over again, except for minor cases, that is. If it didn't drag out, it would just be a perfect world. Enough said.

What a bunch of BS.
I was a huge Carlton Fisk fan, so I've got nothing against him and I've had a DUI of my own. How can a POS lawyer even keep a straight face asking the judge to throw any part of this case out based on "no reasonable suspicion of criminal activity"?? Open bottle of vodka, he reeks like booze, his car is in the middle of a cornfield, he's asleep!!! Give me a break. He should have to go through the whole 9 yards and pay the thousands of dollars for this and lose his license for a period of time and go to the classes and the victim impact panels and have the breathalyzer ignition lock thing in his car just like everyone else.

Your right Jill, just doing his job and Steve...when you get your next DUI, you would only hope to have the intelligence and resources to hire an attorney that will fight for you as it is apparent that you are unwilling to fight for yourself.

You all seem to have him convicted and guilty already. It is called circumstantial evidence guys! Prove that he was drunk or had been drinking. Its all circumstantial.....he never took a test so that will toss it out of court because there is no proof. An open container is illegal yes....but doesnt mean he was driving drunk.

PS. Yes he crossed a center line and ended up in a cornfield....but he had a blown tire on his truck. Perhaps that caused him to lose control of the vehicle. Also people can bump their heads and not have a mark there to show it. This may have caused him to act out of sorts as well as caused him to be asleep when he was found. Circumstantial evidence. The plaintiff in this case is the State of Illinois and they have the burden of proof. There is one thing only in this case that can be proven and that is that he had an open container of alcohol in his truck. The rest of the charges cannot be proven. :) If he has a decent attorney he will put forth all of this defense and Mr. Fisk will walk away with the one proven charge....an open container in the vehicle. Now we sit back and see how intelligent his attorney is.

I think Carlton is having some major financial problems. His 12,000 sq. ft. Florida house was allegedly burglarized by someone who too silver coins and was squatting there. The insurance company will be investigating Fisk's whereabouts when the alleged break in occurred and checking if the home is in foreclosure or almost in foreclosure.
I am not one who takes pleasure from seeing a famous person fall from grace so I wish Carlton and his family all of the best.
